Lis AN ORDINANCE BEFORE THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS AN ORDINANCE ACCEPTING MOUNTAIN RIDGE SUBDIVISION TO THE CITY OF BATESVILLE, ARKANSAS WHEREAS, in Ordinance No. 2005-4-1 the City Council of the City of Batesville, Arkansas, annexed 299.1 acres into the City of Batesville, Arkansas; and WHEREAS, an established sub-division known as Mountain Ridge • Sub-division was platted and was a part of the property annexed; and WHEREAS, at a City Council meeting on April 12, 2005, the City Council requested that prior to accepting the Mountain Ridge Sub-division the Mountain Ridge Sub-division be reviewed by the Batesville Planning Commission; and WHEREAS, Mountain Ridge Sub-division was reviewed and accepted by the Batesville Planning Commission on May 2, 2005; and WHEREAS, attached as Exhibit A is a plat of certain real property known as Mountain Ridge Sub-division which plat was recorded August 5, 2004, Book 2004, page 3358. The Master Bill of Assurance for Mountain �,,,, Ridge Sub-division was recorded on August 9, 2004 in Deed Book 2004, at pages 3415-3436 of the Records of Independence County, Arkansas, and r said Master Bill of Assurance is hereby incorporated by reference as if set word for word. The Supplemental Bill of Assurance for Mountain Ridge Sub-division was recorded on August 9, 2004 in Deed Book 2004, at pages 3437-3446 of the Records of Independence County, and said Supplemental Bill of Assurance is hereby incorporated by reference as if set out word for word. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS: That the Mountain Ridge Subdivision, the Master Bill of Assurance, • and the Supplemental Bill of Assurance, and the property, and all provisions, covenants and restrictions contained in the foregoing plat of Mountain Ridge Sub-division, the Master Bill of Assurance and the Supplemental Bill of Assurance are hereby approved and accepted. FURTHER, the roads as shown on the plat of Mountain Ridge Sub-division are hereby approved and accepted by the City of Batesville, as dedicated public roads, conditioned upon the roads being in compliance with the minimum standards as set forth in Batesville City Ordinance No. 986.
