AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR
OTHER PURPOSES.
WHEREAS, an application was submitted to the Batesville Planning Commission for the
purposed of requesting an amendment to Zoning Districts Map for the below referenced property; and,
WHEREAS, the Batesville Planning Commission has conducted a properly advertised public
hearing on December 8, 2014; and,
WHEREAS, the Batesville Planning Commission has reviewed the relationship of this property
with the Comprehensive Plan; and,
WHEREAS, the Batesville Planning Commission has recommended that the requested
amendment to the Zoning Districts map be approved by the City Council.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BATESVILLE, ARKANSAS THAT THE BATESVILLE ZONING DISTRICTS MAP IS
HEREBY AMENDED AS FOLLOWS:
From Single Family Residential (R-1) to General Family Residential (R-2);
A tract of land being part of Section 14, Township 13 North, Range 6 West, in the City of
Batesville, Independence County, Arkansas, more particularly described as follows:
Commencing at the northwest corner of said Section 14; thence N 00°00'00" E, a distance of
1,628.44'; thence S 00000'0011E a distance of 1,442.11' to a point on the proposed east right
of way line of Dry Kiln Road extended, and the point of beginning; thence along said east
right of way line the following: N 20°03'45"E a distance of 16.56; along a curve to the left,
said curve having a radius of 358.55', an arc length of 49.92' and a long chord bearing and
distance of N 16°04'26" E, 49.88; N 12°05'07" E a distance of 255.22; along a curve to the
right, said curve having a radius of 265.63', an arc length of 90.5 P and a long chord bearing
and distance of N 21 °50'57" E, 90.07; thence N 31 °36'32" E a distance of 44.92' to the south
right of way line of a NORAM gas line easement; thence leaving said right of way line and
along said south line, S 52°34'26" E a distance of 880.29'; thence leaving said south line
S38006110" W a distance of 130.05'; thence N88°18'52" W a distance of 101.73; thence S
O1°41'08" W a distance of 136.83; thence N 70°58'43" a distance 395.83; thence N
52°25'57"W a distance of 339.36 to the point of beginning.
2. From Single Family Residential (R-1) to Community Commercial (C-1):
Two tracts of land being part of Section 14, Township 13 North, Range 6 West, in the City
of Batesville, Independence County, Arkansas, more particularly described as follows:

Commencing at the northwest corner of said Section 14; thence N 00°00'00" E, a distance of
1,628.44; thence S 00°00'00"E a distance of 1,442.11' to a point on the proposed east right
of way line of Dry Kiln Road extended, and the point of beginning; thence S 52°25'57" E a
distance of 339.36; thence N 70°58'43" W a distance of 206.93; thence S 19°01'17" W a
distance of 51.73'; thence N 85°00'49" W a distance of 116.68' to the east right of way line
of Dry Kiln Road; thence N 70°58'43" W along said east right of way line a distance of
5.00; thence N 20°03'45" E along the proposed east right of way line of Dry Kiln Road
extended a distance of 188.0' to the point of beginning; and,
Commencing at the northwest corner of said Section 14; thence N 00°00'00" E, a distance of
1,591.40; thence S 00°00'00"E a distance of 1,543.52' to a point on the proposed east right
of way line of Dry Kiln Road extended, thence S 70°58'43" E a distance of 323.69' to the
point of beginning; thence continue S 70°58'43" E a distance of 395.83; thence N 78°10'41"
W a distance of 398.97; thence N 19°01'17" E a distance of 50.00' and the point of
beginning

IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD
TO BE INVALID, SUCH INVALIDITY SHALL NOT AFFECT THE REMAINING PORTION
OR PORTIONS OF THIS ORDINANCE.
IT IS SO ORDAINED.
