AN ORDINANCE REZONING ANNE)MD PROPERTY OWNED BY
PROFESSIONAL DENTAL TECHNOLOGIES INC. FROM R-I TO i-1
INDUSTRIAL; DECLARING AN EMERGENCY AND OTHER PURPOSES.
BE IT ORDAINED BY THE CITY OF BATESVILE AS FOLLOWS:
(1) The following property be and the same is hereby rezoned from R-1 Residential to 1-1
Industrial. In accordance with municipal ordinance#999, section IV, subsection 4, all
annexed property within the corporate limits of the City of Batesville is required a
pubrlic hearing conducted before the city planning commission€or the determiri�tion
of the most appropriate zoning district for the subject property. The Batesville
Planning Commission conducted a pubfic hearing on September 9, 2002 art has
recommended that the zoning district be designated as I-1 Industrial.
(2} The pfopefty is described as thus:
A tract of land being a part of the East Half(E 1/2) of the East Half(E '/2)
of the Northeast Quarter (NE 1/4) in Section 8, Township 13 North, Range
6 West in the City of Batesville, Independence County,Arkansas, more
particularly described as follows: Commencing at a mound of stones on
the North side of a graveled roadway, the Southwest corner of the
Southeast Quarter (SE '/4) of Northeast Quarter(NE 1/4) of said Section 8;
thence North 02 degrees 19 minutes East a distance of 639.2 feet to a point
on a wire fence; thence South 88 degrees 48 minutes East along said fence
a distance of 10.06 feet; thence North 48 degrees 54 minutes East along
said fence a distance of 40.95 feet to a fence comer; thence North 01
degree 19 minutes East a distance of 595.77 feet along said wire fence to a
point; thence North 22 degrees 49 minutes East a distance of 24.6 feet
along said fence to a fence comer on the South right of way line of White
Drive (Arkansas State Highway ##69); thence North 75 degrees 30 minute
East along said South right of way line a distance of 137.61 feet; thence
North 67 degrees 10 minutes East along said South right of way line a
distance of 194.28 feet; thence North 56 degrees 55 minutes East along
said South right of way line a distance of 390.24 feet to a fence comer at
the Point of Beginning; thence North 56 degrees 05 minutes 25 seconds
East along said South right of way line a distance of 402.7 feet; thence
South 02 degrees 16 minutes 55 seconds West a distance of 655.02 feet
thence North 87 degrees 43 minutes 05 seconds West a distance of 325
feet to an existing fence; thence North 02 degrees 16 minutes 55 secon(
East along said existing fence a distance of 417.23 feet to the Point of
Beginning.

(3) It is hereby found and declared that an emergency exists and that this ordinance being
necessary for the-public welfare; it shall be in full fame and effect from the date of its
passage.
