ORDINANCE NO.
AN ORDINANCE REGARDING REMOVAL OF APPOINTED COMMISSIONERS; AND FOR OTHER
PURPOSES
WHEREAS, Arkansas Code Annotated § 14-42-109 and § 14-356-106 allows the City
Council to provide by Ordinance for the removal of Commissioners by a vote of the council; and
WHEREAS, the Council wishes to have the authority to remove Commissioners by a
three-quarters majority vote;
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE, ARKANSAS:
Section 1. Amending Title 1-General Provisions of the Batesville Municipal Code by
adding the following Section to be Codified as 1.40 to the Batesville City Code:
Section 1.40: Removal of Commisioner That a Member of any Commission appointed
under the City of Batesville's Municipal Code and/or Ordinances may be removed upon a vote
of three -fourths (3/4) of the duly elected members of the City Council.
Section 2: Repealing conflicting Ordinances That any other Ordinances found to be
conflict with this Ordinance are hereby repealed. Specifically, Ordinance, Number 733, Section
4, codified as 2.44.04 under the City Municipal Code is hereby repealed.
Section 3: Invalidity If any portion or portions of this ordinance are deemed or held to
be invalid, such invalidity shall not affect the remaining portions of this ordinance.
Section 4: Emergency Clause That the need for commissioners to be in compliance
with city and state law is immediate. Therefore, an emergency is hereby declared to exist, and
this Ordinance shall be in full force and effect from the date of its adoption

A RESOLUTION AUTHORIZING THE SUBMISSION OF APPLICATIONS FOR
VARIOUS GRANTS; AND FOR OTHER PURPOSES
WHEREAS, the City of Batesville recognizes the importance of increasing safe pedestrian
connectivity between key destinations in Batesville for the safety, mobility and quality of life of
its residents;
WHEREAS, the City of Batesville understands that Federal TAP (Transportation Alternative
Program) funds are available through ARDOT at an 80% federal/20% local match to improve or
develop sidewalks;
WHEREAS, the City of Batesville will apply for the TAP grant in order to construct a 10' side
path connecting the existing Greenway near the Batesville Community Center at Myers Avenue
to the commercial district on Harrison Street through the new River Town development on the
site of the former Batesville Country Club, for the maximum request amount of $500,000 from
ARDOT and a minimum 20% match of $125,100 from the City for a minimum total project cost
of $625,100;
WHEREAS, the developer of River Town has agreed to provide the required matching funds for
the proposed Greenway extension, such that the City of Batesville will incur no costs associated
with the construction thereof;
WHEREAS, the City Council of the City of Batesville, having heard evidence as to the
importance of the following grant funds and the role they would play in the City of Batesville,
wishes to submit an application to be the recipient of such grants.
NOW, THEREFORE, be it resolved by the City Council of the City of Batesville, Arkansas:
Section 1. That the Batesville City Council hereby approves the submission of applications for
the following grant and authorizes the Mayor to execute any such documentation necessary to
complete said application.

Section 2. That the Batesville City Council believes that these grants align with the City's needs
and will greatly benefit the community.
