RESOLUTION NO.
A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK OF
BATESVILLE, ARKANSAS TO ENTER INTO AN AGREEMENT WITH THE
WHITE RIVER PLANNING AND DEVELOPMENT DISTRICT, INC.
WHEREAS, Batesville, Arkansas has received notification of funding approval from the
Arkansas Department of Emergency Management and Federal Emergency Management Agency
to provide funds for a drainage project; and
WHEREAS, Batesville, Arkansas requires assistance to administer the funded drainage
project; and
NOW, THEREFORE, BE IT RESOLVED by the Batesville City Council:
That the Mayor and City Clerk of Batesville, Arkansas be authorized to execute an
Agreement in the amount of Thirty -Three Thousand Two Hundred and Fifty -One Dollars and
No/100 ($33,251.00) with the White River Planning and Development District, Inc., to provide
administrative services of said drainage project in accordance with the Grant application and
award from the Arkansas Department of Emergency Management (ADEM) and Federal
Emergency Administration Agency (FEMA). Management fees will be 100% reimbursed by the
funding agency.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK OF
BATESVILLE, ARKANSAS TO ENTER INTO AN ENGINEERING
AGREEMENT WITH CEA, INC. OF JONESBORO, ARKANSAS
WHEREAS, Batesville, Arkansas, is anticipating receiving funding approval from
the Arkansas Department of Emergency Management and Federal Emergency
Administration Agency for a drainage improvement project; and
WHEREAS, the city has followed the state procurement procedures for selection of
an engineer; and
WHEREAS, it will be necessary for the Mayor and City Clerk to act in connection
with the Engineering Agreement;
NOW, THEREFORE, IT IS RESOLVED that the City Council of Batesville hereby
declares that the Mayor and City Clerk be authorized to execute an agreement in the amount
of Eighty - Thousand Dollars and No/100 ($80,000.00) with CEA, Inc. of Jonesboro,
Arkansas to provide engineering services to the City for the project listed above. Such costs
and contract format to be approved by the funding agency and 75% of such costs will be paid
from the grant funds.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE BATESVILLE WATER UTILITY TO PAYOFF
BETHESDA WATER ASSOCIATION DEBT WITH THE US DEPARTMENT OF
AGRICULTURE
WHEREAS, that the plan to consolidate the Bethesda Water Association into the
Batesville Water Utility has been approved by the Arkansas Department of Agriculture;
WHEREAS, that Bethesda Water currently owes sums to the US Department of
Agriculture for a prior loan;
WHEREAS, that the Council of the City of Batesville has determined that it is in the best
interest for the Batesville Water Utility to payoff said sums.
NOW THEREFORE, BE IT RESOLVED by the Council of the City of
Batesville, Arkansas as follows:
Section 1. The Batesville Water Utility is hereby authorized to pay off the
Debts owed by the Bethesda Water Association to the United States Department of Agriculture in
the amount of $357,633 more or less.

ORDINANCE NO.
AN ORDINANCE REGARDING REMOVAL OF APPOINTED COMMISSIONERS; AND FOR OTHER
PURPOSES
WHEREAS, Arkansas Code Annotated § 14-42-110 allows the City Council to provide by
Ordinance for the removal of Commissioners by a majority vote of the council; and
WHEREAS, the Council wishes to have the authority to remove Commissioners for Cause
by a two-thirds majority vote;
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE, ARKANSAS:
Section 1. Amending Title 1-General Provisions of the Batesville Municipal Code by
adding the following Section to be Codified as 1.40 to the Batesville City Code:
Section 1.40 Removal of Commissioner That a Member of any Commission appointed
under the City of Batesville's Municipal Code and/or Ordinances may be removed for cause
upon a vote of three -fourths (3/4) of the duly elected members of the City Council.
Section 2. Repealing conflicting Ordinances That any other Ordinances found to be
conflict with this Ordinance are hereby repealed. Specifically, Ordinance, Number 733, Section
4, codified as 2.44.04 under the City Municipal Code is hereby repealed.
Section 3: Invalidity If any portion or portions of this ordinance are deemed or held to
be invalid, such invalidity shall not affect the remaining portions of this ordinance.
Section 4: Emergency Clause That the need for commissioners to be in compliance with
city and state law is immediate. Therefore, an emergency is hereby declared to exist, and this
Ordinance shall be in full force and effect from the date of its adoption
