AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE
PURCHASE OF AN AERIAL PLATFORM APPARATUS FOR THE CITY OF
BATESVILLE FIRE DEPARTMENT
WHEREAS, the citizen's of the City of Batesville voted on and passed a
1/8 of 1 percent sales tax to be used for the purchase of an Aerial Platform
Apparatus and other purposes.
WHEREAS, the Batesville Fire Department through Chief Danny Russell
have recommended the matter be referred to the full council for approval.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
BATESVILLE, ARKANSAS:
Section 1. That the City of Batesville Fire Department needs to purchase
an Aerial Platform Apparatus and that said equipment is to be as follows:
Rosenbauer GSE Demo Cobra 104 Aerial Platform Apparatus
Section 2. That said apparatus is to be purchased from the Rosenbauer
Company for the approximate sum of $742,130.00, more or less.
Section 3. That the City Council in accordance with the terms of A.C.A.
Section 14-58-303 hereby waives the requirement of competitive bidding and
directs the Purchasing Officer to purchase the above described equipment for the
price set forth in Section 2 above.
Section 4. EMERGENCY CLAUSE: It is further found that due to the
immediate need to acquire the above described equipment, an emergency is
declared to exist and this ordinance being necessary for the preservation of the
public peace, health and safety shall take effect from and after its passage and
approval.
