ITII�<,k;�°''i' ':b Tr��'?Ai T.- The term "itinerant restaurnnt" shall mean one operating for a temporary period in connection with a fair, carnival, circus, public exhibition, or other similar gathering. C. �- .- teres ''amployee" shall wean any person who handles food or f drink during preparrtion or serving, or who comes in contact with any eating or cooking utensils, or who is employed in a room in which food or drink is j re p,,wed or served. Y:Railr..- It shall be unlawful for any persor= to oiler to a restaurant in the city of Batesville who does not possess an unrovoked permit from the health officer, such permit shall be posted in a conspicuous place. Only persons who Imply with the requirements of this ordinance shall be entitled to receive and retain such a permit. T1R'NT:..- At least once every six (6) months the health officer shall inspect every restaurant located within the city of Batesville. In case the health officer discovers the violation of am item of sanitation he shall make a second inspection atter the lapse of which: tires as he deems necessary for the defect to be remedied, and t`.e second inspection shall be used in determining compliance with the requirements of this ordinance. Any violation of the same item of this ordinance on such second inspection shall call for i7inediate suspension of permit. One copy of the inspection report shall be posted by the health officer upon an inside wall of the restaurEant, and said inspection report shall not bO defaced or removed by any person except the health office. Another copy of the inspection report shall be filed with the records of the proper health authority. Section 8. Section 11. INT.R ,, 'ATIOfl.- This ordinance shall be enfortled by the health officer in accordance with the interpretations thereof contained in the 1943 edition of the U. ". Public Health sarvice Com Regulating; '-atinc and Drinking Establishments, when not in conflict with the Mules and Regul.atigns of the Arkansas State Board of hualth interpretation - in which case the latter interpretation shall take precedence. Certified copies of the above mentioned rules and regulations of the Ctate Board of Health along with the 1943 edition of the U. S. '-ublic Health Service Code regulating Eating and Drinking et-.blishments shall be on file at the City Clerk's office and in the Independence County Health Office. Section 12. 1114AL' 111.- Any person who violates any provision of this ordinance shall be fixed not more than X25.00 (Nenty rive '.:cellars) at the discretion of the court having jurisdiction. �;ach and every violation of the provision of this ordinance shall constitute a separate offense. 3ection 13. IK2ZAL AND DAM X BMFICT.- All ordinances and parts of ordinances in conflict with this ordinance are hereby repealed, and this ordinance shall be in full force and effect imnadiatelw upon its adoption and its publication as provided by law.
