AN ORDINANCE ACCEPTING THE DEDICATION OF CITY
STREETS KNOWN AS WOODLANDS CIRCLE AND
SUGARBERRY COURT TO THE CITY OF BATESVILLE,
ARKANSAS
WHEREAS, Kevin and Kelly Spillers (Spillers Property Investment, LLC) has executed
and delivered to the City of Batesville, Arkansas, its Deed of Dedication for the purpose
of city streets, known as Woodlands Circle and Sugarberry Court, an easement across the
following described property; subdivision known as The Woodlands at Eagle Mountain
located within the city of Batesville:
A tract of land being a part of the West Half of We Northwest Quarter of Section 23,
Township 13 North, Range 6 West in the City of Batesville, Independence County,
Arkansas, more particularly described as follows: commencing at the northwest corner
of said Section 23; thence South 01 degree 59 minutes 40 seconds West along the west
line of said Section 23, 999.0 feet to the southwest corner of the Latter Day Saints
Church tract and the point of beginning; thence South 88 degrees 00 minutes 20 seconds
East, 462.25 feet to the proposed west right of way of a future street; thence along said
proposed west right of way lune the following: South 17 degrees 24 minutes 32 seconds
West, 164.52 feet; along a curve to the left, said curve having a radius of 426.34 feet, a
long chord hearing of South 01 degree 25 minutes 11 seconds West, a long chord distance
of 234.87 feet; South 14 degrees 34 minutes 10 seconds East, 86.57 feet; along a curve to
the right, said curve having a radius of 930.35 feet, a long chord bearing of South 09
degrees 35 minutes 38 seconds East, a long chord distance of 161.38 feet; South 04 degree
37 minutes 06 seconds East, 303.05 feet; thence North 71 degrees 07 minutes 42 seconds
West, 535.96 feet to said west line; thence North 01 degree 59 minutes 40 seconds East,
779.96 feet to the point of beginning. Containing 8.82 acres,more or less, subject to any
and all easements and/or rights of way, public and/or private.
WHEREAS, the said Woodlands Circle and Sugarberry Court has been constructed in
accordance with the requirements of the City of Batesville; and has received a final plat
approval from the Batesville Planning Commission on 06-04-07; and the public benefit
will be served by the acceptance and maintenance of the roads.
BE IT THEREFORE ORDAINED BY THE CITY COUNCIL OF BATESVILLE,
ARKANSAS:
That the City of Batesville hereby accepts for purposes of maintenance, the public
streets known as Woodlands Circle and Sugarberry Court.
This ordinance adopted this 25th day of April 2011.
