ORDINANCE NO.
AN ORDINANCE TO PROVIDE FOR THE ZONING
CLASSIFICATION OF CERTAIN LANDS SITUATED
IN SECTION 15, TOWNSHIP 13 NORTH, RANGE
6 WEST.
WHEREAS, the City of Batesville, Arkansas, has accepted
(the annexation to it of certain contiguous lands hereinafter
(particularly described; and,
WHEREAS, the City Planning Commission of the City of
Batesville, Arkansas has, following proper publication of notice,
held a hearing as required by statute upon the proper zoning
classification of the lands herein described; and,
WHEREAS, the City Planning Commission has recommended
that these lands be given a C-2 Commercial Zoning classification.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the
City Council of the City of Batesville, Arkansas:
1. That the lands hereinafter described, being a part
of the City of Batesville, Arkansas, be and hereby are given a
C-2 Commercial Zoning classification, the lands being particularli
described as follows:
A part of the Southwest Quarter of the Southeast Quarter
of Section 15, Township 13 North, Range 6 West, described
as follows: Beginning at the Northwest corner of said
Southwest Quarter of the Southeast Quarter, thence East
759 links (500.94 ft.), thence South 26 1/2 degrees West
799 links (_527.34 ft.), thence North 75 3/4 degrees West
418 links (_275.88 ft.) to the line dividing the
Southeast Quarter and the Southwest Quarter of said
Section 15, thence North on said line 604 links (398.64 ft.)
to place of beginning, containing four (4) acres, more
or less.
And a part of the Northwest Quarter of the Southeast
Quarter of Section 15, Township 13 North, Range 6 West,
described as follows: Beginning at the Southwest corner
of said Northwest Quarter of the Southeast Quarter,
thence East 759 links (500.94 ft.) to South side of
State Highway No. 69, thence in a Northwesterly direction
along South and West side of said Highway to intersection
of line dividing the Southeast Quarter of the Southwest
Quarter, of said Section 15, thence South on said line
800 links (_528. ft.) to place of beginning, containing
two and one-half (2 1/2) acres, more or less.
A part of the Southwest Quarter of the Southeast
Quarter of Section 15, Township 13 North, Range 6 west,
described by metes and bounds as follows: Beginning

at the Northwest corner of said Southwest Quarter of
the Southeast Quarter, thence South 604 links (398.64 ft.)
to the Southwest corner of a 4 -acre tract deeded to
W. H. Handford, June 6, 1945 by Mrs. Myrtle McCormack
as shown in Deed Record Y-5, page 580 for the beginning
point of this conveyance, thence in a Southeasterly
direction along and adjacent to the South boundary line
of said 4 -acre tract 418 links (275.88 ft.) to a point,
thence South 26 1/2 degrees West 410 links (270.6 ft.)
thence North 75 3/4 degrees West 157 links (103.62 ft.)
more or less, to a point on quarter section line 300
links (198 ft.) South of the beginning point of this
conveyance; thence North on Quarter Section line 300
links (198 ft.) to the beginning point of this conveyance,
containing in said tract 1 1/8 acres, more or less,
and reserving and excepting for ourselves (the Browns)
a 15 foot strip off the entire West side of the above
described tract, leaving in the above conveyance to
said grantee herein (_W. H. Handford) 1 acre, more or
less.
2. That proper zoning classifications being necessary
for the immediate preservation of the public peace, health and
(safety of the citizens of Batesville, Arkansas, an emergency is
(hereby declared to exist and this ordinance shall be in full force
and effect immediately after its passage.

ZONING CLASSIFICATION RECOMMENDATION
TO THE CITY COUNCIL OF THE
CITY OF BATESVILLE, ARKANSAS:
PLEASE BE ADVISED that a petition has been filed before
the City Planning Commission of the City of Batesville, Arkansas,
by HOMER D. BAILE`i and 11. D. BAILEY, JR., requesting; a C-2
Commercial Zoning Classification for the following described
lands:
A part of the Southwest Quarter of the Southeast Quarter
of Section 15, Township 13 North, Range 6 West, described
as follows: Beginning at the Northwest corner of said
Southwest Quarter of the Southeast Quarter, thence East
759 links (500.94 ft.), thence South 26 1/2 degrees West
799 links (527.34 ft.), thence North 75 3/4 degrees nest
418 links (275.88 ft.) to the line dividing the
Southeast Quarter and the Southwest Quarter of said
Section 15, thence North on said line 604 links (398.64 ft.)
to place of beginning, containing four (4) acres, more
or less.
And a part of the Northwest Quarter of the Southeast
Quarter of Section 15, Township 13 North, Range 6 West,

And upon the filing of said petition same was set for hearing;
before the Batesville City Planning Commission on the 3rd day of
August, 1976, at 7:00 o'clock P.M., and notice of such public
hearing was published in the Batesville Guard, a newspaper with
a genuine and bora fide circulation within the City of Batesville,
Arkansas, as required by law, and following; the public hearing
on the aforesaid petition the City Planning Commission did, after
being well and sufficiently advised in the premises, find as
follows:
1. That on the 3rd day of August, 1976, an order has
been entered by the County Court of Independence County, Arkansas,
ordering; the above-described lands to be annexed to the City of
Batesville, Arkansas.
2. That the zoning; classification sought for the
above-described land is proper and in the public interest, and
that such land should, when annexed, be given a C-2 Commercial
zoning classification by Zoning Ordinance.
IT IS, THEREFORE, CONSIDERED AND RECO14MENDED by the
City Planning Commission of the City of Batesville, Arkansas that
in the event the annexation of the above-described lands to the
City of Batesville, Arkansas, is accepted by the City Council
that such lands should be given a C-2 Commercial zoning; classifi-
cation by the adoption of such a zoning ordinance.
