AN ORDINANCE LEVING A PROSECUTION FEE OF TEN DOLLARS ($10.00) ON EACH
MISDEMEANOR AND TRAFFIC OFFENSE BROUGHT IN THE BATESVILLE MUNICIPAL COURT;
DESIGNATING ITS USE; SETTING A PARTIAL SALARY FOR THE CITY ATTORNEY'S
APPEARANCES IN COURT; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS:
Section 1: Pursuant to Ark. Stat. Ann. §19-1025.1 a Ten Dollar ($10.00)
prosecution fee is hereby levied and shall be collected by the Batesville
Municipal Court as Court Costs for each defendant upon a plea of guilty, nolo
contendre, forfeiture of bond or determination of guilt for all misdemeanors
and traffic offenses brought before said court.
Section 2: Said fee shall be deposited by the City Clerk in the general
revenue funds of the City of Batesville, and will be used to help defray the
cost of law enforcement and other administration of justice offenses.
A Section 3: The City Attorney's salary is hereby increased in the amount of
,3tA.CC $3� per month. Said increase shall be in addition to any other salary he
may now or hereinafter receive and is intended to be the salary and compensation
for municipal and Circuit Court criminal prosecutions handled by him.
Section 4: If any part or parts of this ordinance is declared unconstitutional
or otherwise illegal or unlawful then that part or parts will be considered to
be severed from this ordinance and any remaining part or parts of this ordinance
shall continue in full force and effect as if the severed portions were never '
a part of this ordinance.
Section 5: All ordinances or parts of ordinances in conflict herewith are
hereby repealed.
Section 6: It is hereby found that the expenses of law enforcement and the
criminal justice system are steadily increasing; that the salary of the City
Attorney does not adequately compensate the City Attorney for time spent in
Municipal and Circuit Court; that payment of said expenses is necessary for
the administration of justice. Wherefore, an emergency is hereby declared
to exist and this ordinance, being necessary for the public peace, health
and safety, shall be in full force and effect from and after the date of its
passage.
